![]() Imagine a 45mph road where the green light is on for 30-45 seconds in the expectation that X number of cars will get through at the speed limit, and yet only a handful of them get through because of driver behavior in response to literal interpretation of this law. ![]() If it were followed throughout our state, our roads would grind to a halt as every vehicle going through an intersection, even straight, became obliged to stop at the limit line until the vehicle ahead was completely through and one car length past. I'm not a lawyer, but that anti-gridlock regulation seems to set an unreasonably high standard for motorists. But the street suddenly clogged when I was mostly finished with my turn and I spent the remainder of the light on the crosswalk. I began my turn at the beginning of the light, and the few cars in front of me were moving at normal speed, as well as the the cars in the street I was turning into. What are some strategies that I would have to argue for fighting it?Īs per the original situation, it wasn't like I was taking the gamble of turning on a yellow light, or even the tail end of a green light. I'm leaning towards that or just asking for leniency. and also I'm now eligible for trial by declaration if I pay the $281 in bail.įrom what I've read, I have a better chance of getting it dismissed if I do trial by declaration, and even if I lose I have the right to a trial in person. I can also set up a court trial and fight it in court. The worst case scenario is that I pay the $281, but being a poor student living on student loans, I would much rather not.Īt the arraignment, my friend's lawyer dad said I can explain my situation and ask for leniency. It's not a moving violation-I don't get any points from it and there's not need for me to take traffic school. I would like to fight the ticket or at least get the fine reduced. I set an arraignment date for July 13th for the gridlock violation. I already presented my proof of insurance to a clerk so the insurance thing isn't an issue. Any advice you could give me would be greatly appreciated. Thanks for plowing through such a long post. bonafide full time traffic cop, the chances that he'll show up in court are pretty high. I think that since I got pulled over by a motorcycle, ie. I would've much rather done this by written declaration, and I don't see why I'm not eligible. I don't have that much money in my account to be honest, so I'll have to go to the clerk the day after I get back and present proof of my insurance and then request one of the court appearances. The Amount Due is $1081 if I have to schedule an appearance by mail. It also says that no other options are available to me and that I'm not eligible for a Trial by Declaration. I can also mail the "Amount Due for a Court Appearance" and select Arraignment (appearance to hear my charges, advisement of rights, and entry of plea) or Court Trial (to contest the citation) and schedule a court appearance by mail. Request Court Appearance (Optional): I can request an Arraignment date without posting bail by appearing in person at the Clerk's office. Present Proof of Correction to a clerk of the court and pay $281 On the letter I received, my options are: Because I didn't have proof of insurance, my total amount due is $1081, but with proof of correction it's $281 which is still a lot. The violations I got written up for are VC-22526A-I and VC16028a-I. The thing is, I don't think I was blocking the intersection, and short of not moving at all for the entire minute the turn light was green, there was no other place I could really go. Also unfortunately for me, my boyfriend didn't update our insurance card and I also go written up for that too. He was writing us tickets at the same time, and told me he was writing that guy up for the same thing, which was blocking the intersection. Unfortunately for me, it was the last day of the month and a motorcycle cop pulled both me and the red truck behind me over (if it matters, he then pulled someone over right after he wrote us up so he was definitely in a ticket trap mood). The road that I was turning into was really busy and going very slowly, so when the arrow turned red, I was still stuck on the crosswalk. There was a sign to yield to pedestrians under the left arrow, so I stopped to let the pedestrians cross on the crosswalk before I went over it. After the arrow turned green, all the cars proceeded to turn left at a normal speed and I followed. I was probably the third or fourth car waiting in the left turn lane. I was driving in downtown Mountain View during lunch hour when I got pulled over making a left turn. I was wondering if you have any advice on my options, or rather, ways to fight it. I recently got pulled over for gridlock and I have a huge traffic ticket from it. My question involves traffic court in the State of: California
